๑. ความเปนมา
ดวยกองทุนเพื่อความเสมอภาคทางการศึกษา (กสศ.) มีแผนกลยุทธ กสศ. ป ๒๕๖๘ - ๒๕๗๐ โดย สถาบันวิจัยเพื่อความเสมอภาคทางการศึกษา (วสศ.) ดำเนินงานภายใตแผนงานที่ ๔ ซึ่งมุงเนนการสื่อสาร การพัฒนา องคความรู การวิจัย และนวัตกรรมเพื่อความเสมอภาคทางการศึกษา ไดจัดทำแผนการพัฒนานวัตกรรมและการวิจัย พ.ศ. ๒๕๖๙ ประกอบดวย ๓ แผนงานสำคัญไดแก (๑) แผนงานขอมูลและการติดตามสถานการณความเหลื่อมล้ำ ทางการศึกษา (๒) แผนงานวิจัยเชิงระบบและการประเมินผล (๓) แผนงานสงเสริมนวัตกรรมและเครือขายนักวิจัย และนวัตกรรมเพื่อความเสมอภาคทางการศึกษา โดยมุงเนนการพัฒนาองคความรูและนวัตกรรมผานการศึกษาวิจัย และถอดบทเรียน รวมถึงการใชประโยชนขอมูลงานวิจัยและนวัตกรรมผานการสรางการมีสวนรวมของภาคีภาคสวน ตาง ๆ ดังนั้นการเผยแพรองคความรู ขอมูล และผลงานทางวิชาการ จึงเปนจุดเริ่มตนในการสรางการรับรูและ ขับเคลื่อนความเสมอภาคทางการศึกษาตอไป
ในสภาวะปจจุบันที่ชองทางการสื่อสารมีการเปลี่ยนแปลงอยางรวดเร็ว (Digital Transformation) และ ความตองการของผูมีสวนไดสวนเสีย (Stakeholder) มีความหลากหลายมากขึ้น เพื่อใหการดำเนินงานของสถาบันวิจัย เพื่อความเสมอภาคทางการศึกษา (วสศ.) การเผยแพรองคความรู ผลงานวิชาการ เปนที่รับรู เขาถึงงาย และสราง ความเชื่อมั่นใหกับสังคมไดอยางมีประสิทธิภาพ ความชัดเจนของกลยุทธการสื่อสาร (Brand Communication Strategy) จึงเปนสวนสำคัญที่จะชวยรอยเรียงทิศทางการเลาเรื่อง (Storytelling) และภาพลักษณ (Visual Identity)
เพื่อใหสามารถสื่อสารคุณคาและจุดยืนที่ชัดเจนแกกลุมเปาหมายไดอยางมีประสิทธิภาพ
สถาบันวิจัยเพื่อความเสมอภาคทางการศึกษา (วสศ.) จึงไดพิจารณาการจัดทำโครงการเผยแพรองคความรู และพัฒนาเว็บไซตสถาบันวิจัยเพื่อความเสมอภาคทางการศึกษา โดยทำใหองคความรู งานวิจัยของ วสศ. กลายเปน พลังสนับสนุนการขับเคลื่อนงานของ กสศ. โดยยึดหลักการ Master Brand Architecture ที่ วสศ. ทำหนาที่เปน Research Engine ขององคกร และทุกผลลัพธของงานวิจัยตองเสริมความนาเชื่อถือและบทบาทของ กสศ. ในฐานะ แพลตฟอรมระดมความรวมมือเพื่อลดความเหลื่อมล้ำทางการศึกษาที่ขับเคลื่อนดวยงานวิจัย ฐานขอมูลและหลักฐาน เชิงประจักษ
๒. วัตถุประสงค
๑. เพื่อพัฒนาระบบการสื่อสารงานวิจัยและองคความรูเพื่อสนับสนุนบทบาทของ วสศ. ในการเสริมภาพลักษณ ของ กสศ. ในฐานะองคกรแหงการเรียนรูที่ขับเคลื่อนการเปลี่ยนแปลงดวยขอมูลและงานวิจัย ๒. เพื่อออกแบบและพัฒนาเว็บไซต(ระบบ Knowledge Platform) ที่สอดคลองกับอัตลักษณองคกร (Visual Identity) ของ กสศ. เพื่อใหงานวิจัยและองคความรูของ วสศ. เขาถึงงาย นาเชื่อถือ และสามารถนำไปใช ประโยชนไดจริงสำหรับกลุมเปาหมายทุกกลุม

  ๓. เพื่อพัฒนาศักยภาพนักวิชาการของ กสศ. ใหเกิดการเรียนรูกระบวนการพัฒนาระบบการสื่อสารงานวิจัย และองคความรูตอกลุมเปาหมายและสาธารณชนอยางลึกซึ้ง เพื่อสนับสนุนเปาหมายการเปนองคกรแหงการ เรียนรู
  ๓. คุณสมบัติของผูยื่นขอเสนอ
  ๓.๑ มีความสามารถตามกฎหมาย
  ๓.๒ ไมเปนบุคคลลมละลาย
  ๓.๓ ไมอยูระหวางเลิกกิจการ
  ๓.๔ ไมเปนบุคคลซึ่งอยูระหวางถูกระงับการยื่นขอเสนอหรือทำสัญญากับหนวยงานของรัฐไวชั่วคราวเนื่องจาก เปนผูที่ไมผานเกณฑการประเมินผลการปฏิบัติงานของผูประกอบการตามระเบียบที่รัฐมนตรีวาการกระทรวงการคลัง กำหนดตามที่ประกาศเผยแพรในระบบเครือขายสารสนเทศของกรมบัญชีกลาง
  ๓.๕ ไมเปนบุคคลซึ่งถูกระบุชื่อไวในบัญชีรายชื่อผูทิ้งงานและไดแจงเวียนชื่อใหเปนผูทิ้งงานของหนวยงานของรัฐ ในระบบเครือขายสารสนเทศของกรมบัญชีกลาง ซึ่งรวมถึงนิติบุคคลที่ผูทิ้งงานเปนหุนสวนผูจัดการ กรรมการ ผูจัดการ ผูบริหาร ผูมีอำนาจในการดำเนินงานในกิจการของนิติบุคคลนั้นดวย
  ๓.๖ มีคุณสมบัติและไมมีลักษณะตองหามตามที่คณะกรรมการนโยบายการจัดซื้อจัดจางและการบริหารพัสดุ ภาครัฐกำหนดในราชกิจจานุเบกษา
  ๓.๗ มีสถานะเปน
  🗹 บุคคลธรรมดา 🗹 นิติบุคคล ผูมีอาชีพขายพัสดุหรือผูมีอาชีพรับจางงาน ที่มีลักษณะเชนเดียวกัน กับขอบเขตของงานโครงการนี้
  ๓.๘ ไมเปนผูมีผลประโยชนรวมกันกับผูยื่นขอเสนอรายอื่นที่เขายื่นขอเสนอ ใหแก กองทุนเพื่อความเสมอภาค ทางการศึกษา ณ วันยื่นขอเสนอหรือวันประกาศประกวดราคาอิเล็กทรอนิกส หรือไมเปนผูกระทำการอันเปนการ ขัดขวางการแขงขันอยางเปนธรรม ในการยื่นขอเสนอหรือการประกวดราคาอิเล็กทรอนิกสครั้งนี้
  ๓.๙ ไมเปนผูไดรับเอกสิทธิ์หรือความคุมกัน ซึ่งอาจปฏิเสธไมยอมขึ้นศาลไทย เวนแตรัฐบาลของผูยื่นขอเสนอไดมี คำสั่งใหสละเอกสิทธิ์และความคุมกันเชนวานั้น
  ๓.๑๐ ผูยื่นขอเสนอที่ยื่นขอเสนอในรูปแบบของ “กิจการรวมคา” ตองมีคุณสมบัติดังนี้
  กรณีที่ขอตกลงระหวางผูเขารวมคากำหนดใหผูเขารวมคารายใดรายหนึ่งเปนผูเขารวมคาหลัก ขอตกลง ระหวางผูเขารวมคาจะตองมีการกำหนดสัดสวนหนาที่และความรับผิดชอบในปริมาณงาน สิ่งของ หรือมูลคาตามสัญญา ของผูเขารวมคาหลักมากกวาผูเขารวมคารายอื่นทุกราย
  กรณีที่ขอตกลงระหวางผูเขารวมคากำหนดใหผูเขารวมคารายใดรายหนึ่งเปนผูเขารวมคาหลัก กิจการรวมคา นั้นตองใชผลงานของผูเขารวมคาหลักรายเดียวเปนผลงานของกิจการรวมคาที่ยื่นขอเสนอ
  สำหรับขอตกลงระหวางผูเขารวมคาที่ไมไดกำหนดใหผูเขารวมคารายใดเปนผูเขารวมคาหลัก ผูเขารวมคาทุกราย จะตองมีคุณสมบัติครบถวนตามเงื่อนไขที่กำหนดไวในเอกสารเชิญชวน หรือหนังสือเชิญชวน

  กรณีที่ขอตกลงระหวางผูเขารวมคากำหนดใหมีการมอบหมายผูเขารวมคารายใดรายหนึ่งเปนผูยื่นขอเสนอ ในนามกิจการรวมคา การยื่นขอเสนอดังกลาวไมตองมีหนังสือมอบอำนาจ
  สำหรับขอตกลงระหวางผูเขารวมคาที่ไมไดกำหนดใหผูเขารวมคารายใดเปนผูยื่นขอเสนอ ผูเขารวมคาทุกราย จะตองลงลายมือชื่อในหนังสือมอบอำนาจใหผูเขารวมคารายใดรายหนึ่งเปนผูยื่นขอเสนอในนามกิจการรวมคา ๓.๑๑ □ ผูยื่นขอเสนอตองมีผลงาน 🗹 ไมกำหนดเปนคุณสมบัติของผูยื่นขอเสนอ
  □ การจำหนายพัสดุ ประเภทเดียวกันกับขอบเขตของงานโครงการนี้ซึ่งไดสงมอบพัสดุและมีผลการ ตรวจรับเปนที่เรียบรอยแลว ภายในระยะเวลาไมเกิน…..ป นับถึงวันยื่นขอเสนอโดยมีมูลคางานในวงเงิน ไมนอยกวา …………………. บาท (……………………..) ตอ ๑ สัญญา และเปนผลงานที่เปนคูสัญญาโดยตรงกับหนวยงานของรัฐ หรือ หนวยงานเอกชน ที่กองทุนเพื่อความเสมอภาคทางการศึกษา เชื่อถือ
  □ รับจางงาน ประเภทเดียวกันกับขอบเขตของงานโครงการนี้ซึ่งไดสงมอบพัสดุและมีผลการตรวจรับ เปนที่เรียบรอยแลว ภายในระยะเวลาไมเกิน…………ป นับถึงวันยื่นขอเสนอโดยมีมูลคางานในวงเงิน ไมนอยกวา …………………. บาท (……………………..) ตอ ๑ สัญญา และเปนผลงานที่เปนคูสัญญาโดยตรงกับหนวยงานของรัฐ หรือ หนวยงานเอกชน ที่กองทุนเพื่อความเสมอภาคทางการศึกษา เชื่อถือ
  ๓.๑๒ ผูยื่นขอเสนอตองมีมูลคาสุทธิของกิจการ ดังนี้
  ๓.๑๒.๑ กรณีผูยื่นขอเสนอเปนนิติบุคคลที่จัดตั้งขึ้นตามกฎหมายไทย/กฎหมายตางประเทศ ซึ่งไดจดทะเบียน เกินกวา ๑ ป ตองมีมูลคาสุทธิของกิจการ จากผลตางระหวางสินทรัพยสุทธิหักดวยหนี้สินสุทธิที่ปรากฏในงบแสดง ฐานะการเงินที่มีการตรวจรับรองแลว ของ ๑ ปสุดทายกอนวันยื่นขอเสนอ ซึ่งจะตองแสดงคาเปนบวก
  ๓.๑๒.๒ กรณีผูยื่นขอเสนอเปนนิติบุคคลที่จัดตั้งขึ้นตามกฎหมายไทย/กฎหมายตางประเทศ ซึ่งยังไมมีการ รายงานงบแสดงฐานะการเงินกับกรมพัฒนาธุรกิจการคา ใหพิจารณาการกำหนดมูลคาของทุนจดทะเบียน โดยผูยื่น ขอเสนอจะตองมีทุนจดทะเบียนที่เรียกชำระมูลคาหุนแลว ณ วันที่ยื่นขอเสนอ ดังนี้
  (๑) มูลคาการจัดซื้อจัดจางไมเกิน ๑ ลานบาท ไมตองกำหนดทุนจดทะเบียน
  (๒) มูลคาการจัดซื้อจัดจางเกิน ๑ ลานบาท แตไมเกิน ๕ ลานบาท ตองมีทุนจดทะเบียนไมตํ่ากวา ๑ ลานบาท
  (๓) มูลคาการจัดซื้อจัดจางเกิน ๕ ลานบาท แตไมเกิน ๑๐ ลานบาท ตองมีทุนจดทะเบียน ไมต่ำกวา ๒ ลานบาท
  (๔) มูลคาการจัดซื้อจัดจางเกิน ๑๐ ลานบาท แตไมเกิน ๒๐ ลานบาท ตองมีทุนจดทะเบียน ไมตํ่ากวา ๓ ลานบาท

  ๓.๑๒.๓ กรณีผูยื่นขอเสนอเปนบุคคลธรรมดาถือสัญชาติไทย/บุคคลธรรมดาที่มิไดถือสัญชาติไทย ผูยื่นขอเสนอตองมีเงินฝากคงเหลือในบัญชีธนาคารเปนมูลคาไมนอยกวา ๑ ใน ๔ ของมูลคางบประมาณ ของโครงการนี้หรือรายการที่ยื่นขอเสนอในแตละครั้ง โดยหนังสือรับรองบัญชีเงินฝากซึ่งธนาคารออกใหแกผูยื่น ขอเสนอนับถึงวันยื่นขอเสนอตองมีอายุไมเกิน ๙๐ วัน
  ทั้งนี้ หากผูยื่นขอเสนอเปนผูชนะการจัดซื้อจัดจางหรือเปนผูไดรับการคัดเลือก จะตองแสดงหนังสือรับรอง บัญชีเงินฝากที่มีมูลคาดังกลาวอีกครั้งหนึ่งในวันลงนามในสัญญาหรือใบสั่งจาง โดยหนังสือรับรองบัญชีเงินฝากซึ่ง ธนาคารออกใหแกผูยื่นขอเสนอนับถึงวันลงนามในสัญญาหรือใบสั่งจางตองมีอายุไมเกิน ๙๐ วัน
  ๓.๑๒.๔ กรณีที่ผูยื่นขอเสนอมีคุณสมบัติไมเปนไปตามขอ ๓.๑๒.๑ ขอ ๓.๑๒.๒ และขอ ๓.๑๒.๓ ผูยื่นขอเสนอสามารถขอหนังสือรับรองวงเงินสินเชื่อที่ธนาคารภายในประเทศ หรือบริษัทเงินทุนหรือ บริษัทเงินทุนหลักทรัพยที่ไดรับอนุญาตใหประกอบกิจการเงินทุนเพื่อการพาณิชยและประกอบธุรกิจค้ำประกัน ตามประกาศของธนาคารแหงประเทศไทย ตามรายชื่อบริษัทเงินทุนที่ธนาคารแหงประเทศไทยแจงเวียนใหทราบ หรือเปนสินเชื่อที่ธนาคารตางประเทศหรือบริษัทเงินทุนหรือบริษัทเงินทุนหลักทรัพยที่ไดรับอนุญาตใหประกอบ กิจการเงินทุนเพื่อการพาณิชยและประกอบธุรกิจค้ำประกันตามประกาศของธนาคารกลางของประเทศนั้น ตาม รายชื่อบริษัทเงินทุนที่ธนาคารกลางของประเทศนั้นแจงเวียนใหทราบ โดยพิจารณาจากยอดเงินรวมของวงเงินสินเชื่อ ที่สำนักงานใหญรับรอง หรือที่สำนักงานสาขารับรอง (กรณีไดรับมอบอำนาจจากสำนักงานใหญ) ซึ่งออกใหแกผูยื่น ขอเสนอ นับถึงวันยื่นขอเสนอไมเกิน ๙๐ วัน โดยตองมีวงเงินสินเชื่อจากธนาคารไมนอยกวา ๑ ใน ๔ ของมูลคา งบประมาณของโครงการนี้หรือรายการที่ยื่นขอเสนอในแตละครั้ง ทั้งนี้ สำหรับธนาคารภายในประเทศหนังสือรับรอง วงเงินสินเชื่อใหเปนไปตามแบบที่คณะกรรมการวินิจฉัยปญหาการจัดซื้อจัดจางและการบริหารพัสดุภาครัฐกำหนด ๓.๑๒.๕ กรณีนิติบุคคลที่จัดตั้งขึ้นตามกฎหมายตางประเทศและบุคคลธรรมดาที่มิไดถือสัญชาติไทย ตามขอ ๓.๑๒.๒ ขอ ๓.๑๒.๓ และขอ ๓.๑๒.๔ มูลคาจะตองเปนไปตามอัตราแลกเปลี่ยนเงินตราตามประกาศที่ธนาคารแหง ประเทศไทยกำหนดในชวงระหวางวันที่เผยแพรประกาศและเอกสารเชิญชวนในระบบจัดซื้อจัดจางภาครัฐดวย อิเล็กทรอนิกส (e-GP) หรือมีหนังสือเชิญชวน จนถึงวันเสนอราคา
  ๓.๑๓ ผูยื่นขอเสนอตองลงทะเบียนที่มีขอมูลถูกตองครบถวนในระบบจัดซื้อจัดจางภาครัฐดวยอิเล็กทรอนิกส (Electronic Government Procurement : e-GP) ของกรมบัญชีกลาง
  ทั้งนี้ ผูยื่นขอเสนอจะตองผานคุณสมบัติเบื้องตนตามขอ ๓. กอน กสศ. จึงจะนำขอเสนอโครงการมา พิจารณาคัดเลือกตอไป

  ๔. รายละเอียดคุณลักษณะเฉพาะของพัสดุที่จะดำเนินการจัดซื้อ หรือขอบเขตของงานที่จะดำเนินการจัดจางและ เอกสารแนบทายอื่น ๆ
  ๔.๑ ผูยื่นขอเสนอที่เปนผูชนะการจัดซื้อจัดจางหรือเปนผูไดรับการคัดเลือกตองดำเนินการ/ใหบริการ ดังนี้
  ๔.๑.๑ เขารวมประชุมกับ กสศ. เพื่อรับฟงแนวทางการดำเนินงาน วางแผนรวมกัน และทำความเขาใจ Master Brand Architecture ของ กสศ. ที่งานวิจัยตองสอดคลองและเสริมความแข็งแกรงให รวมถึงทำ ความเขาใจบทบาทของ วสศ. ในฐานะ Research Engine ที่ตองการ Positioning ที่ชัดเจนภายใต กสศ.
  ๔.๑.๒ จัดทำแผนการดำเนินโครงการฯ เพื่อสื่อสารงานวิจัยและฐานขอมูล และพัฒนาเว็บไซตวสศ. (ระบบ Knowledge Platform) เพื่อสงเสริมความนาเชื่อถือของ กสศ. พรอมระบุตัวชี้วัดความสำเร็จรายเดือนที่ ชัดเจน (เชน สถิติการเขาชม ยอดการดาวนโหลด)
  ๔.๑.๓ วิเคราะหภาพรวมการสื่อสารงานวิจัยและองคความรูของ วสศ. ในปจจุบัน เพื่อประเมินวางานวิจัย ถูกใชเสริมแบรนด กสศ. ไดอยางเต็มศักยภาพหรือไม และระบุชองวางที่ตองพัฒนา ครอบคลุมทั้งมิติ Content การออกแบบ ชองทางการสื่อสาร และการรับรูของกลุมเปาหมาย
  ๔.๑.๔ ออกแบบกรอบชุดคำถามสำหรับการสัมภาษณเชิงลึก (In Depth Interview) กลุมผูมีสวนไดสวนเสีย (Stakeholder) และกลุมเปาหมาย ทั้งภายในและภายนอกองคกร
  ๔.๑.๕ ดำเนินการสัมภาษณเชิงลึก (In Depth Interview) กลุมผูมีสวนไดสวนเสีย (Stakeholder) และ กลุมเปาหมายทั้งภายในและภายนอกองคกร จำนวน ๑๒ คน พรอมสรุปและวิเคราะหผล เพื่อนำมาจัดทำ กลยุทธการสื่อสารองคความรูและงานวิจัย
  ๔.๑.๖ วิเคราะหองคกรและแพลตฟอรมวิจัยที่เทียบเคียงไดในระดับประเทศและนานาชาติ เพื่อหาตัวอยางที่ดี (Best Practice) ในการสื่อสารงานวิจัยที่เสริมแบรนดองคกรหลัก โดยใชงานวิจัยเปนเครื่องมือเสริมแบรนดหลัก
  ๔.๑.๗ จัดทำกลยุทธการสื่อสารองคความรู งานวิจัยของ วสศ. ภายใตแบรนด กสศ. โดยอยางนอยตองดำเนินการ/ ใหบริการ ดังตอไปนี้
  (๑) Research Communication Strategy — กำหนดวิธีแปลงงานวิจัยและฐานขอมูลใหเปน ภาษาที่กลุมเปาหมายแตละกลุมเขาใจและนำไปใชไดจริง
  (๒) Brand Architecture Positioning — กำหนดตำแหนงของ วสศ. ใน Architecture ของ กสศ. อยางชัดเจน ในฐานะ Endorsed Brand ที่เปน Research Engine ของ กสศ. พรอมกำหนด บทบาทและจุดยืนของ วสศ. ใหชัดเจนและสอดคลองกันทั้งภายในและภายนอกองคกร
  (๓) Core Messages รายกลุมเปาหมาย — ชุดสารหลักสำหรับผูกำหนดนโยบาย ภาคเอกชน นักวิชาการ สื่อมวลชน บุคลากรทางการศึกษา และ พลเมืองตื่นรู (Active Citizen)

  (๔) Tone & Manner — น้ำเสียงและรูปแบบการนำเสนองานวิจัยที่สอดคลองกับ brand character ของ กสศ.
  (๕) Content Distribution Strategy — แนวทางการกระจายเนื้อหาผานชองทางที่เหมาะสมกับ แตละกลุมเปาหมาย
  ๔.๑.๘ กำหนดแนวทางการเผยแพรองคความรูใหตรงกับความตองการของแตละกลุม โดยทุก Touchpoint ตองเสริมภาพลักษณ กสศ. ในฐานะ “องคกรที่ขับเคลื่อนดวยขอมูลและหลักฐาน” ครอบคลุม

๔.๑.๙ จัดทำอัตลักษณของวสศ. (Corporate Identity) โดยอางอิงจากคูมือแบรนด กสศ. และให สอดคลองกับ Visual Identity ของ กสศ. พรอมจัดทำคูมือการใชงานอัตลักษณ(Guideline) โดยอยาง นอยตองประกอบดวย
(๑) การออกแบบโลโก
(๒) การออกแบบระบบการนำเสนอองคความรูมีองคประกอบดังนี้

• Content Template Design สำหรับการสื่อสารงานวิจัยทุกรูปแบบที่ กสศ. เปนเจาของลิขสิทธิ์ เชน Infographic และ Social Media Post

  (๔) การตรวจสอบและเพิ่มประสิทธิภาพการทำงานของระบบเว็บไซต

• ระบบบริหารจัดการเนื้อหาบนเว็บไซต(Content Management System)

• ระบบสงตอเนื้อหาหลังบาน ตามบทบาทของผูใชงาน (Role) บนเว็บไซต

• การเพิ่มประสิทธิภาพของระบบเว็บไซต(Performance Optimization)

• ความปลอดภัยและความเสถียรของระบบเว็บไซต(Security & System Stability) - ทดสอบระบบการทำงานและแสดงผล (Testing & Quality Assurance)
  (๕) Features หลักของเว็บไซต

• ฟงกชันการทำงาน (Functional Features) ไดแก การแบงปนเนื้อหา เชน รูปภาพ วิดีโอ บทความผานแพลตฟอรมโซเชียลมีเดีย, แบบฟอรมสำหรับเก็บขอมูลผูเขาใชงานเว็บไซต, ติดตั้งเครื่องมือ Google Analytic เพื่อเก็บขอมูลและวิเคราะหพฤติกรรมผูใชงานบนเว็บไซต, การกำหนดขนาดความกวางหนาจอของเว็บไซตในการปรับเปลี่ยนการจัดวางเนื้อหา เพื่อใหเหมาะสมกับทุกอุปกรณ, ความสามารถของเว็บไซตที่แสดงผลและทำงานไดถูกตอง เหมือนกันบนทุกเบราวเซอร, การทำงานของหมวดหมู และ Tag พรอมการแสดงผลที่ถูกตอง - การตั้งคาโครงสราง ๒ ภาษา ไดแก ภาษาไทยและภาษาอังกฤษ

• การใสเนื้อหาบนเว็บไซต จำนวน ๑๒ หนา (Content Implementation)
  (๖) การตั้งคา SEO
  ทั้งนี้ ผลงานจะตองไดรับความเห็นชอบจาก วสศ. กอนสงมอบงาน พรอมทั้งสามารถปรับเปลี่ยน หรือแกไขผลงาน เพื่อใหเปนไปตามวัตถุประสงคของโครงการ
  ๔.๑.๑๑ จัดทำคูมือและถายทอดวิธีการใชงานเว็บไซตวสศ. ที่พัฒนาแกนักวิชาการของ วสศ.

  ๔.๑.๑๒ ดำเนินการเชาระบบ Hosting ระยะเวลา ๓๖๕ วัน นับถัดจากวันลงนามในสัญญา เพื่อดำเนินการ ออกแบบ พัฒนาเว็บไซตวสศ.(https://research.eef.or.th/) และทดสอบระบบกอนดำเนินการถายโอนไป ยังระบบ Hosting ของ วสศ. ปจจุบัน รวมทั้งสวนของความปลอดภัย เชน การรองรับระบบ HTTPS (Hypertext Transfer Protocol Secure)
  ๔.๑.๑๓ ดำเนินการทดสอบการใชงานเว็บไซตจริงกับกลุมเปาหมายทุกกลุม (User Testing) ตามที่ระบุ ในขอ ๔.๑.๘ และรวบรวมผลตอบรับ (Feedback) และขอเสนอแนะของกลุมเปาหมายไปปรับปรุงแกไข ใหเว็บไซตวสศ. มีความสมบูรณยิ่งขึ้น
  ๔.๑.๑๔ ใหนักวิชาการ วสศ. เขาไปมีสวนรวมเรียนรูกระบวนการการออกแบบและพัฒนากลยุทธการ สื่อสารงานวิจัยและองคความรูตลอดจนการพัฒนาเว็บไซตอยางลึกซึ้งตลอดทั้งโครงการ เพื่อสนับสนุน เปาหมายการเปนองคกรแหงการเรียนรู
  ๔.๒ ขอเสนออื่น ๆ
  ๔.๒.๑ ผูรับจางตองยอมรับการตรวจสอบดานความปลอดภัยของระบบเทคโนโลยีสารสนเทศที่อยูใน ขอบเขตงานนี้ ทั้งจาก กสศ. หรือหนวยงานอื่น ๆ ที่ กสศ. แตงตั้งใหเปนผูตรวจสอบ และหากตรวจพบชองโหวดาน ความปลอดภัยของระบบ ผูรับจางตองดำเนินการแกไขใหแลวเสร็จโดยเร็วที่สุดตามที่กำหนดในนโยบายการรักษา ความปลอดภัยของระบบสารสนเทศของ กสศ. โดยไมคิดคาใชจาย
  ๔.๒.๒ ผูพัฒนาระบบตองพัฒนาระบบภายใตขอกำหนดของกฎหมายและนโยบายการรักษาระบบสารสนเทศ ของ กสศ. ประกอบดวย
  (๑) พระราชบัญญัติการรักษาความมั่นคงปลอดภัยไซเบอร พ.ศ. ๒๕๖๒
  (๒) พระราชบัญญัติ วาดวยธุรกรรมทางอิเล็กทรอนิกส พ.ศ. ๒๕๔๔ และที่แกไขเพิ่มเติม
  (๓) พระราชบัญญัติคุมครองขอมูลสวนบุคคล พ.ศ. ๒๕๖๒
  (๔) มาตรฐานเว็บไซตภาครัฐ เวอรชัน ๒.๐ หรือรุนใหมกวาที่ภาครัฐประกาศใช
  (๕) นโยบายการรักษาความมั่นคงปลอดภัยสารสนเทศของ กสศ. (ISO/IEC ๒๗๐๐๑:๒๐๑๓) (๖) แนวปฏิบัติที่ดี OWASP (Open Web Application Security Project)
  (๗) ประกาศคณะกรรมการการรักษาความมั่นคงปลอดภัยไซเบอรแหงชาติ เรื่อง มาตรฐานเว็บไซตที่ มั่นคงปลอดภัย พ.ศ. ๒๕๖๘
  (๘) กฎ ระเบียบอื่นใดที่เกี่ยวเนื่องกับกฎหมายขางตน
  ๔.๒.๓ (ถามี) ผูรับจางตองสรุปรายการแหลงในการจัดหาขอมูลในการติดตอ ขอมูลราคาและขอมูลอื่นที่ เกี่ยวของกับครุภัณฑและ/หรือบริการทางเทคโนโลยีสารสนเทศที่ กสศ. มิไดเปนผูรับผิดชอบ และทาง กสศ. จำเปนตองดำเนินการจัดหาครุภัณฑและ/หรือบริการทางเทคโนโลยีสารสนเทศดังกลาวหลังจากสิ้นสุดสัญญานี้ เพื่อใหระบบตามรายละเอียดขอ ๔.๑ สามารถใชงานไดปกติ

ผูยื่นขอเสนอที่เปนผูชนะการจัดซื้อจัดจางหรือเปนผูไดรับการคัดเลือก (ซึ่งตอไปรวมเรียกวา “ผูขาย /ผูรับจาง”) จะตองสงมอบใบแจงหนี้มาพรอมกับใบสงของหรือหนังสือสงมอบงานภายในวันเดียวกัน หรือภายใน ๕ วันทำการ นับแตวันที่สงมอบพัสดุหรือผลงาน ทั้งนี้ การนำสงใบแจงหนี้ลาชาเกินกวากำหนดเวลาดังกลาวใหถือวา ผูขาย/ผูรับจางยังมิไดมีการสงมอบพัสดุหรือผลงานภายในกำหนดระยะเวลาตามสัญญาหรือหรือใบสั่งจาง
๗.๒ เงื่อนไขการจายเงิน
เมื่อคณะกรรมการตรวจรับพัสดุในงานซื้อหรืองานจางไดตรวจรับพัสดุ/ผลงานไวโดยชอบแลว กสศ. จะดำเนินการ เบิกจายเงินงวดคาพัสดุ/คาผลงาน เปนเงินจำนวนตามสัดสวนของพัสดุ/ผลงานที่คณะกรรมการตรวจรับพัสดุฯ ได ตรวจรับไวใหแกผูขาย/ผูรับจาง โดยวิธีการโอนเงินคาพัสดุ/คาผลงาน ที่ไดหักคาธรรมเนียมธนาคาร คาปรับ คาเสียหาย ภาษี ณ ที่จาย และภาษีอากรอื่นทั้งปวง รวมถึงคาฤชาธรรมเนียมและคาใชจายอื่นใด (ถามี) แลว เขาบัญชีเงินฝาก ธนาคารชื่อบัญชีของผูขาย/ผูรับจางเทานั้น

  กรณีผูขาย/ผูรับจางมิไดสงมอบพัสดุหรือผลงานภายในกำหนดระยะเวลาตามสัญญาหรือใบสั่งจาง ถือวาผูขาย/ ผูรับจางกระทำผิดสัญญาและจะตองชำระคาปรับใหแก กสศ. ดังนี้
  ◻ กรณีผลสำเร็จของงานเปนรายงวด ตองชำระคาปรับเปนรายวันในอัตรารอยละ ๐.๒ ของราคาพัสดุที่ยัง ไมไดรับมอบ หรือของราคางานจางนั้น
  🗹 กรณีผลสำเร็จของงานทั้งหมดพรอมกัน ตองชำระคาปรับเปนรายวันในอัตรารอยละ ๐.๑ ของราคางานจาง นั้นแตจะตองไมต่ำกวาวันละ ๑๐๐ บาท
  ๑๐. การกำหนดระยะเวลารับประกันความชำรุดบกพรอง (ถามี)
  ๑๐.๑ ผูขาย/ผูรับจางตองรับประกันความชำรุดบกพรองของพัสดุ/ผลงานที่สงมอบ เปนระยะเวลาไมนอยกวา ๑ ปนับถัดจากวันที่กสศ. ไดตรวจรับพัสดุ
  ๑๐.๒ กรณี กสศ. แจงใหผูขาย/ผูรับจางดำเนินการแกไขพัสดุ/ผลงานใหถูกตองครบถวนตามที่กำหนด ในสัญญา/ใบสั่งจาง ผูขาย/ผูรับจางตองดำเนินการแกไขใหแลวเสร็จภายใน ๗ วัน นับถัดจากวันที่ไดรับแจงเปน ลายลักษณอักษรจาก กสศ.
  ๑๑. สถานที่สงมอบพัสดุ
  ณ สำนักงานกองทุนเพื่อความเสมอภาคทางการศึกษา หรือสถานที่อื่นใดตามที่ กสศ. กำหนด หรือผานทาง อีเมลของ กสศ. ([email protected]) ภายในเวลา ๑๗.๓๐ น.ของทุกวันทำการ (โดยนับเวลาที่ กสศ. ไดรับอีเมล ทั้งนี้หากสงมอบหลังเวลาดังกลาวใหถือวาเปนการสงมอบงานในวันทำการถัดไป)

  ◻ มีการหักเงินที่จะจายคาพัสดุ/คาจางแตละงวดในอัตรารอยละ ๕ ของงวดนั้น และ กสศ. จะคืนเงินประกัน ผลงานดังกลาวใหโดยไมมีดอกเบี้ยพรอมกับการจายเงินคาพัสดุ/คาจางในงวดสุดทาย

• บุคลากรหรือทีมงานมีความเชี่ยวชาญ ความพรอมและประสบการณ ในการทำ กลยุทธการสื่อสารองคความรู งานวิจัยและพัฒนาเว็บไซต ๑ - ๓ ป และมีการ นำเสนอผลงานที่ผานมาในขอบเขตงานลักษณะใกลเคียงกัน (๒๐ คะแนน)

• บุคลากรหรือทีมงานมีความเชี่ยวชาญ ความพรอมและประสบการณ ในการทำ กลยุทธการสื่อสารองคความรู งานวิจัยและพัฒนาเว็บไซต นอยกวา ๑ ป และมี การนำเสนอผลงานที่ผานมาในขอบเขตงานลักษณะใกลเคียงกัน (๑๐ คะแนน)

ทั้งนี้ ผูเสนอราคาที่ไดคะแนนเกณฑคุณภาพ รอยละ ๗๐ ขึ้นไป จะถือวาเปนผูผานเกณฑการพิจารณา คัดเลือกขอเสนอ
หมายเหตุ :
(๑) คณะกรรมการฯ ทรงไวซึ่งสิทธิที่จะไมรับราคาต่ำสุด หรือราคาหนึ่งราคาใด หรือราคาที่เสนอทั้งหมดก็ได และอาจพิจารณาเลือกซื้อในจำนวน หรือประเภท หรือเฉพาะรายการหนึ่งรายการใด หรืออาจจะยกเลิกการจัดซื้อ จัดจางโดยไมพิจารณาคัดเลือกก็ได ตามที่เห็นสมควร ทั้งนี้ เพื่อประโยชนของ กสศ. และเปาหมายของงานเปนสำคัญ และใหถือวาการตัดสินของคณะกรรมการฯ เปนที่สุด ผูยื่นขอเสนอจะเรียกรองคาเสียหายใด ๆ มิได
(๒) กรณีมีผูผานเกณฑราคาประกอบเกณฑอื่นไดคะแนนรวมเทากันหลายราย กสศ. ขอสงวนสิทธิในการ คัดเลือกผูยื่นขอเสนอที่ไดคะแนนเกณฑคุณภาพสูงสุดเปนผูชนะการจัดซื้อจัดจางหรือเปนผูที่ไดรับคัดเลือก
๑๖. กำหนดยืนราคาไมนอยกวา ๖๐ วัน
๑๗. กำหนดวันทำสัญญาหรือขอตกลงเปนหนังสือ ภายใน ๑๕ วัน นับถัดจากวันที่ไดรับแจงจาก กสศ.

  ๑๙. การบอกเลิกสัญญาหรือขอตกลงเปนหนังสือ
  ๑๙.๑ ถาผูขาย/ผูรับจาง ไมทำงานใหแลวเสร็จภายในระยะเวลาที่กำหนด หรือไมสงมอบพัสดุ/ไมสงมอบงาน ใหเปนไปตามกำหนดในสัญญาหรือใบสั่งจาง กสศ. มีสิทธิบอกเลิกสัญญาหรือใบสั่งจาง และไมจายเงินคาพัสดุ/ คาจางทั้งหมดของงวดงานที่ลาชาได
  ๑๙.๒ กสศ. มีสิทธิบอกเลิกสัญญาหรือใบสั่งจางได ในกรณีที่เห็นวาพัสดุ/พัสดุ ตามสัญญาหรือใบสั่งจาง ไมมีความจำเปนที่จะตองใชงานอีกตอไป หรือในกรณีการดำเนินงานหรือรับมอบพัสดุ/ผลงานตามสัญญาหรือใบสั่ง จางตอไป จะไมเปนประโยชนแก กสศ. ทั้งนี้ กสศ. จะพิจารณาตรวจรับพัสดุ/ผลงาน และเบิกจายเงินคาพัสดุ/คาจาง ตามความเปนจริงโดยคำนวณตามจำนวนพัสดุ/ปริมาณงาน ที่ไดดำเนินการหรือตรวจรับไวโดยชอบแลว
  ๑๙.๓ กสศ. มีสิทธิบอกเลิกสัญญาหรือใบสั่งจาง ถาเห็นวาผูขาย/ผูรับจางมิไดปฏิบัติงานดวยความชำนาญหรือ มิไดปฏิบัติตามขอสัญญาหรือใบสั่งจางขอหนึ่งขอใด และเงื่อนไขที่กำหนดในสัญญาหรือใบสั่งจาง ในกรณีเชนนี้ กสศ. จะบอกกลาวใหผูขาย/ผูรับจางทราบ เมื่อผูขาย/ผูรับจางไดรับหนังสือบอกกลาวนั้นแลว ผูขาย/ผูรับจางตองหยุด ปฏิบัติงานทันที
  ๑๙.๔ กสศ. อาจมีหนังสือบอกกลาวใหผูขาย/ผูรับจางทราบลวงหนาเมื่อใดก็ไดวา กสศ. มีเจตนาที่จะระงับ การทำงานทั้งหมด หรือแตบางสวน หรือจะบอกเลิกสัญญาหรือใบสั่งจาง ในกรณีการบอกเลิกสัญญาหรือใบสั่งจาง ดังกลาวจะมีผลในเวลาไมนอยกวา ๓๐ วัน นับจากวันที่ผูขาย/ผูรับจางไดรับหนังสือบอกกลาวนั้น เมื่อครบกำหนดเวลา ดังกลาวแลวผูขาย/ผูรับจางตองหยุดปฏิบัติงานทันที
  ๑๙.๕ หากผูขาย/ผูรับจาง และพนักงาน ลูกจาง ตัวแทน หรือบุคคลอื่นใดที่ไดรับมอบหมายของผูขาย/ ผูรับจาง (ซึ่งตอไปรวมเรียกวา “ลูกจาง”) กระทำดวยประการใด ๆ อันเปนการทำผิดสัญญาหรือใบสั่งจาง โดยมิชอบ โดยจงใจหรือประมาทเลินเลอ ทำให กสศ. ไดรับความเสียหาย ผูขาย/ผูรับจาง ตกลงยินยอมให กสศ. ใชสิทธิบอกเลิก สัญญาหรือใบสั่งจาง และมีสิทธิเรียกรองคาเสียหายจากผูขาย/ผูรับจาง โดยให กสศ. มีสิทธินำคาเสียหายมาหักออก จากคาพัสดุ/คาจางได และหากยังไมเพียงพอกับความเสียหายที่เกิดขึ้น กสศ. มีสิทธิเรียกรองคาเสียหายจากผูขาย/ ผูรับจาง จนกวาจะไดรับครบจำนวน
  ๒๐. ขอมูลสวนบุคคล
  ๒๐.๑ นโยบายคุมครองขอมูลสวนบุคคล
  ผูขาย/ผูรับจาง ตกลงจะศึกษาและรับทราบนโยบายการคุมครองขอมูลสวนบุคคลของ กสศ. นโยบาย การคุมครองขอมูลสวนบุคคลสำหรับคูสัญญา รวมถึงนโยบายและประกาศอื่นใดที่เกี่ยวของกับการคุมครองขอมูล สวนบุคคลของ กสศ. ทั้งที่มีผลใชบังคับอยูในขณะนี้ รวมถึงที่จะมีผลใชบังคับตอไปภายหนา โดยผูขาย/ผูรับจางตกลง ปฏิบัติตามนโยบายและประกาศดังกลาวอยางเครงครัด ทั้งนี้ ผูขาย/ผูรับจางตกลงจะติดตามนโยบายและประกาศ ดังกลาวของ กสศ. ที่เว็บไซตของ กสศ. (www.eef.or.th)
  ๒๐.๒ การประมวลผลขอมูลสวนบุคคล และเงื่อนไขในการประมวลผลขอมูลสวนบุคคล
  ๒๐.๒.๑ การประมวลผลขอมูลสวนบุคคล
  ◻ การดำเนินงานของโครงการนี้ไมมีการประมวลผลขอมูลสวนบุคคล
• ๑๖ -
  🗹 การดำเนินงานของโครงการนี้ผูขาย/ผูรับจางตองดำเนินการเก็บรวบรวม ใช หรือเปดเผยขอมูล สวนบุคคล (ซึ่งตอไปนี้รวมเรียกวา “ประมวลผลขอมูลสวนบุคคล”) โดยมีรายละเอียดตามรายการประมวลผลขอมูล สวนบุคคลเอกสารแนบทายขอบเขตงานนี้
  ทั้งนี้ กรณีมีการประมวลผลขอมูลสวนบุคคลผูขาย/ผูรับจางตองประมวลผลขอมูลสวนบุคคลเพียงเทาที่ จำเปนเพื่อใหการดำเนินงานบรรลุตามวัตถุประสงคของโครงการตามรายการประมวลผลขอมูลสวนบุคคลที่กำหนดไว ในขอตกลงการประมวลผลขอมูลสวนบุคคล รวมถึงตกลงจะดำเนินการอื่นใดที่เกี่ยวของกับการประมวลผลขอมูล สวนบุคคลใหสอดคลองกับกฎหมายวาดวยการคุมครองขอมูลสวนบุคคล
  ๒๐.๒.๒ กรณีการดำเนินงานตามโครงการนี้ไมมีการประมวลผลขอมูลสวนบุคคลแตผูขาย/ผูรับจางได ประมวลผลขอมูลสวนบุคคล หรือกรณีที่โครงการนี้มีการประมวลผลขอมูลสวนบุคคลแตผูขาย/ผูรับจางได ประมวลผลขอมูลสวนบุคคลนอกเหนือหรือเกินไปจากที่กำหนดไวในรายการประมวลผลขอมูลสวนบุคคลตามที่ กำหนดในขอตกลงการประมวลผลขอมูลสวนบุคคล ใหถือวาการประมวลผลขอมูลสวนบุคคลดังกลาวของผูขาย/ ผูรับจางเปนการประมวลผลขอมูลสวนบุคคลในฐานะผูควบคุมขอมูลสวนบุคคลตามกฎหมายวาดวยการคุมครอง ขอมูลสวนบุคคลอยางเปนอิสระแยกจาก กสศ. ทั้งนี้
  (๑) กรณีเจาของขอมูลสวนบุคคลหรือบุคคลอื่นใด ใชสิทธิฟองรอง หรือใชสิทธิเรียกรอง หรือใชสิทธิอื่นใด เนื่องจากการประมวลผลขอมูลสวนบุคคลของผูขาย/ผูรับจาง ผูขาย/ผูรับจางตกลงรับผิดชอบในบรรดาความเสียหาย ทั้งปวงแตเพียงผูเดียว
  (๒) กรณีเจาของขอมูลสวนบุคคลหรือบุคคลอื่นใด ใชสิทธิฟองรอง หรือใชสิทธิเรียกรอง หรือใชสิทธิอื่นใด ให กสศ. ชดใชคาเสียหายเนื่องจากการประมวลผลขอมูลสวนบุคคลของผูขาย/ผูรับจาง ผูขาย/ผูรับจางตกลงจะชดใช คาเสียหายและคาใชจายทั้งปวงที่เกิดขึ้นแทน กสศ. ทั้งนี้ การที่ผูขาย/ผูรับจางชดใชเงินและคาเสียหายดังกลาวไมเปน การตัดสิทธิของ กสศ. ในการดำเนินการตามกฎหมาย
  ๒๑. การรักษาขอมูลไวเปนความลับ
  ๒๑.๑ ผูขาย/ผูรับจาง และลูกจาง ตองเก็บรักษาขอมูลและรายละเอียดตาง ๆ ที่เกิดขึ้นจากการทำงานตาม สัญญาหรือใบสั่งจาง ทั้งในระหวางระยะเวลาในสัญญาหรือใบสั่งจาง และหลังสิ้นสุดสัญญาหรือใบสั่งจาง ไวเปน ความลับ ไมมอบหรือเปดเผยขอมูลแกผูอื่นโดยไมไดรับอนุญาตจาก กสศ. และ/หรือเอาไปเพื่อประโยชนอื่นใดแก ตนเอง โดยหากมีการนำไปใช หรือเปดเผย หรือเผยแพร ขอมูลดังกลาวอันจะกอใหเกิดความเสียหายแก กสศ. ผูขาย/ ผูรับจาง จะตองรับผิดชอบตอการกระทำดังกลาว และ กสศ. มีสิทธิดำเนินการตามกฎหมายกับผูขาย/ผูรับจาง
  ๒๑.๒ ขอมูลที่เปนความลับทั้งที่อยูในรูปของเอกสาร โปรแกรมคอมพิวเตอร ขอมูลอิเล็กทรอนิกสที่บันทึกลง ในสื่อตาง ๆ หรือสิ่งอื่นใดที่เปนรูปธรรมที่ กสศ. เปดเผยแกผูขาย/ผูรับจาง ผูขาย/ผูรับจาง ตองทำเครื่องหมาย “ลับ” ไวกับสิ่งนั้นอยางชัดเจน สวนการเปดเผยขอมูลที่เปนความลับดวยวาจาหรือดวยวิธีการอื่นใดที่ไมเปนรูปธรรม ซึ่ง กสศ. ไดแจงใหผูขาย/ผูรับจาง ทราบ ณ เวลาเปดเผยนั้นวาเปนการเปดเผยขอมูลที่เปนความลับ ผูขาย/ผูรับจาง จะตอง สรุปสาระสำคัญของขอมูลที่เปนความลับดังกลาวเปนลายลักษณอักษร พรอมทั้งทำเครื่องหมาย “ลับ” หรือ เครื่องหมายที่มีความหมายทำนองเดียวกันนี้ไวกับขอความสรุปนั้นอยางชัดเจน พรอมทั้งสงมอบขอความสรุปดังกลาว ใหแก กสศ. ภายใน ๑๕ วัน นับตั้งแตวันที่ กสศ. เปดเผยขอมูลที่เปนความลับนั้น

  ๒๑.๓ ผูขาย/ผูรับจางตกลงจะเก็บรักษาขอมูลที่เปนความลับที่ กสศ. ไดเปดเผยแกผูขาย/ผูรับจาง รวมถึงจะ จัดใหมีมาตรการที่เหมาะสมตามมาตรฐานของการรักษาความมั่นคงปลอดภัยของขอมูลที่เปนความลับนั้นเพื่อปองกัน มิใหบุคคลภายนอกเขาถึงขอมูลที่เปนความลับได
  ๒๒. กรรมสิทธิ์ในผลงาน และสิทธิในทรัพยสินทางปญญา
  ๒๒.๑ ผลงาน ซึ่งหมายความรวมถึงขอมูล รายงาน เอกสาร ผลการศึกษา วิเคราะห วิจัย และที่เรียกชื่ออื่นใด ทั้งหมดที่ผูรับจางและ/หรือลูกจาง เปนผูดำเนินการหรือไดรับจากการดำเนินงานภายใตสัญญาหรือใบสั่งจาง ใหผลงาน ดังกลาวเปนกรรมสิทธิ์ของ กสศ.
  ๒๒.๒ สิทธิเหนือทรัพยสินทางปญญาใด ๆ (ไมวาจะเปนลิขสิทธิ์ สิทธิบัตร หรือสิทธิในทรัพยสินทางปญญาใด ๆ) ในผลงานตามของ ๒๒.๑ ที่ผูรับจางและ/หรือลูกจางของผูรับจางไดสรางสรรค ประพันธ สรางขึ้น หรือจัดทำขึ้นจาก การดำเนินงานภายใตสัญญาหรือใบสั่งจางใหเปนของ กสศ.
  ๒๒.๓ หากผูรับจางประสงคจะนำสิทธิในทรัพยสินทางปญญาของ กสศ. ไปใชจะตองไดรับความยินยอมเปน หนังสือจาก กสศ. กอน
  ๒๓. การประเมินผลการปฏิบัติงานของผูประกอบการ
  ผูชนะการจัดซื้อจัดจางหรือคูสัญญาจะตองไดรับการประเมินผลการปฏิบัติงานตามหลักเกณฑที่คณะกรรมการนโยบาย การจัดซื้อจัดจางและการบริหารพัสดุภาครัฐกำหนด เพื่อใชประกอบการพิจารณาคุณสมบัติของผูยื่นเสนอราคาใน ครั้งถัดไป โดยพิจารณาจากเกณฑดังตอไปนี้
  ๒๓.๑ ความถูกตองครบถวน ผลงานตองเปนไปตามรายละเอียดคุณลักษณะ (TOR) ทุกประการ ๒๓.๒ ความตรงตอเวลา การสงมอบงานในแตละงวดงานตองไมเกินระยะเวลาที่กำหนดในสัญญา ๒๓.๓ คุณภาพของงาน ความเรียบรอย การแกปญหาเฉพาะหนา และการปฏิบัติตามมาตรฐานวิชาชีพ ๒๓.๔ การปฏิบัติตามกฎหมาย/ระเบียบ เชน การปฏิบัติตามมาตรการความปลอดภัย หรือกฎหมายแรงงาน
  โดยรูปแบบการใหคะแนนเปนไปตามเกณฑกรมบัญชีกลางและคณะกรรมการตรวจรับพัสดุจะประเมินผลเมื่อสิ้นสุด สัญญา
  ๒๔. เงื่อนไขอื่น ๆ
  กรณีวงเงินงบประมาณตามขอ ๘. เปนเงินจากงบประมาณรายจายประจำปงบประมาณถัดไป กสศ. จะลงนาม ในสัญญาหรือใบสั่งจางกับผูขาย/ผูรับจางก็ตอเมื่อพระราชบัญญัติงบประมาณรายจายประจำปงบประมาณนั้นมีผลใช บังคับและ กสศ. ไดรับการจัดสรรงบประมาณรายจายประจำปจากสำนักงบประมาณแลว
  ทั้งนี้ กสศ. ขอสงวนสิทธิในการยกเลิกการจัดซื้อจัดจางครั้งนี้ กรณีที่ กสศ. ไมไดรับการจัดสรรงบประมาณ เพื่อการจัดซื้อจัดจางโครงการนี้
