จ้างเหมาออกแบบข้อมูลสารสนเทศทางห้องปฏิบัติการ (DDC Lab data center) เพื่อเฝ้าระวังป้องกันควบคุมโรค จำนวน 1 งาน

1. ความเป็นมา
   สถาบันบำราศนราดูรมีภารกิจหลักในการเฝ้าระวัง ป้องกัน และควบคุมโรค โดยอาศัยข้อมูลทาง ห้องปฏิบัติการเป็นข้อมูลสำคัญในการยืนยันการวินิจฉัยและติดตามสถานการณ์โรค อย่างไรก็ตาม ปัจจุบัน ระบบข้อมูลห้องปฏิบัติการยังมีลักษณะกระจัดกระจาย ไม่สามารถเชื่อมโยงข้อมูลระหว่างหน่วยงานได้แบบ เรียลไทม์ ส่งผลให้การวิเคราะห์ข้อมูลและการตัดสินใจเชิงนโยบายยังขาดประสิทธิภาพ
   ดังนั้น จึงมีความจำเป็นต้องดำเนินการ จ้างเหมาออกแบบข้อมูลสารสนเทศทางห้องปฏิบัติการ (DDC Lab Data Center) เพื่อสร้างโครงสร้างข้อมูลกลางการรายงานเชื้อก่อโรคทางห้องปฏิบัติการ (Lab Centralized Data Architecture) ที่สามารถเชื่อมโยงข้อมูลจากห้องปฏิบัติการในระดับเขต และส่วนกลาง เพื่อรองรับการเฝ้าระวังโรคและตอบโต้ภาวะฉุกเฉินทางสาธารณสุขได้อย่างมีประสิทธิภาพ 2. วัตถุประสงค์
   2.1 เพื่อจัดทำ prototype ข้อมูลสารสนเทศทางห้องปฏิบัติการของกรมควบคุมโรค (DDC Lab data center) เพื่อเฝ้าระวังป้องกันควบคุมโรค
   2.2 เพื่อจัดทำชุดข้อมูลสารสนเทศทางห้องปฏิบัติการที่สามารถเชื่อมโยงข้อมูล ระหว่างห้องปฏิบัติการ ในระดับเขตกับส่วนกลาง เพื่อใช้ในการเฝ้าระวังและควบคุมโรคได้อย่างทันท่วงที
   2.3 เพื่อรองรับการเชื่อมโยงข้อมูลระหว่างหน่วยงาน (Interoperability) ออกแบบแนวทาง และโครงสร้างรองรับการเชื่อมโยงข้อมูลระหว่างหน่วยงานที่เกี่ยวข้อง เช่น ห้องปฏิบัติการสถาบันบำราศนราดูร ให้สามารถแลกเปลี่ยนข้อมูลได้อย่างมีประสิทธิภาพ
   2.4 เพื่อสนับสนุนการวิเคราะห์ข้อมูลเชิงระบาดวิทยา (Epidemiological Analytics) ออกแบบ โครงสร้างข้อมูลและแนวทางการใช้ข้อมูลสำหรับการวิเคราะห์สถานการณ์โรคในเชิงระบาดวิทยา โดยสามารถ นำข้อมูลผลการตรวจทางห้องปฏิบัติการไปใช้ในการติดตามแนวโน้มของโรค การตรวจจับความผิดปกติ และการเฝ้าระวังโรคได้อย่างมีประสิทธิภาพ
   2.5 เพื่อสนับสนุนการจัดทำ Dashboard และการตัดสินใจเชิงนโยบาย (Decision Support) ออกแบบโครงสร้างข้อมูลและแนวทางในการนำเสนอข้อมูลในรูปแบบ Dashboard ที่เหมาะสม โดยสามารถ แสดงข้อมูลสำคัญ เช่น จำนวนการตรวจ แนวโน้มของโรค ระยะเวลาในการรายงานผล (Turnaround Time) และตัวชี้วัดที่เกี่ยวข้อง สนับสนุนการตัดสินใจเชิงนโยบายด้านการเฝ้าระวัง ป้องกัน และควบคุมโรคได้อย่าง มีประสิทธิภาพ
2. คุณสมบัติของผู้ยื่นข้อเสนอ
   3.1 มีความสามารถตามกฎหมาย
   3.2 ไม่เป็นบุคคลล้มละลาย
   3.3 ไม่อยู่ระหว่างเลิกกิจการ
   3.4 ไม่เป็นบุคคลซึ่งอยู่ระหว่างถูกระงับการยื่นข้อเสนอหรือทำสัญญากับหน่วยงานของรัฐไว้ชั่วคราว เนื่องจากเป็นผู้ที่ไม่ผ่านเกณฑ์การประเมินผลการปฏิบัติงานของผู้ประกอบการตามระเบียบที่รัฐมนตรีว่าการ กระทรวงการคลังกำหนดตามที่ประกาศเผยแพร่ในระบบเครือข่ายสารสนเทศของกรมบัญชีกลาง
   3.5 ไม่เป็นบุคคลซึ่งถูกระบุชื่อไว้ในบัญชีรายชื่อผู้ทิ้งงาน และได้แจ้งเวียนชื่อให้เป็นผู้ทิ้งงานของ หน่วยงานของรัฐในระบบเครือข่ายสารสนเทศของกรมบัญชีกลาง ซึ่งรวมถึงนิติบุคคลที่ผู้ทิ้งงานเป็นหุ้นส่ ผู้จัดการ กรรมการผู้จัดการ ผู้บริหาร ผู้มีอำนาจในการดำเนินงานในกิจการของนิติบุคคลนั้นด้วย 3.6 มีคุณสมบัติ…

   3.6 มีคุณสมบัติและไม่มีลักษณะต้องห้ามตามที่คณะกรรมการนโยบายการจัดซื้อจัดจ้าง และการบริหารพัสดุภาครัฐกำหนดในราชกิจจานุเบกษา
   3.7 เป็นนิติบุคคลหรือบุคคลธรรมดาผู้มีอาชีพรับจ้างที่ประกวดราคาจ้างด้วยวิธีประกวดราคา อิเล็กทรอนิกส์ดังกล่าว
   ๓.๘ ไม่เป็นผู้มีผลประโยชน์ร่วมกันกับผู้ยื่นข้อเสนอรายอื่นที่เข้ายื่นข้อเสนอให้แก่สถาบันบำราศนราดูร ณ วันประกาศประกวดราคาอิเล็กทรอนิกส์หรือไม่เป็นผู้กระทำการอันเป็นการขัดขวางการแข่งขันอย่างเป็น ธรรมในการประกวดราคาอิเล็กทรอนิกส์ครั้งนี้
   3.9 ไม่เป็นผู้ได้รับเอกสิทธิ์หรือความคุ้มกัน ซึ่งอาจปฏิเสธไม่ยอมขึ้นศาลไทยเว้นแต่รัฐบาลของ ผู้ยื่นข้อเสนอได้มีคำสั่งให้สละเอกสิทธิ์และความคุ้มกันเช่นว่านั้น
   3.10 ผู้ยื่นข้อเสนอที่ยื่นข้อเสนอในรูปแบบของ “กิจการร่วมค้า” ต้องมีคุณสมบัติดังนี้ กรณีที่ข้อตกลงระหว่างผู้เข้าร่วมค้ากำหนดให้ผู้เข้าร่วมค้ารายใดรายหนึ่งเป็นผู้เข้าร่วมค้าหลัก ข้อตกลงระหว่างผู้เข้าร่วมค้าจะต้องมีการกำหนดสัดส่วนหน้าที่และความรับผิดชอบในปริมาณงาน สิ่งของหรือ มูลค่าตามสัญญาของผู้เข้าร่วมค้าหลักมากกว่าผู้เข้าร่วมค้ารายอื่นทุกราย
   กรณีที่ข้อตกลงระหว่างผู้เข้าร่วมค้ากำหนดให้ผู้เข้าร่วมค้ารายใดรายหนึ่งเป็นผู้เข้าร่วมค้าหลัก กิจการร่วมค้านั้นต้องใช้ผลงานของผู้เข้าร่วมค้าหลักรายเดียวเป็นผลงานของกิจการร่วมค้าที่ยื่นข้อเสนอ สำหรับข้อตกลงระหว่างผู้เข้าร่วมค้าที่ไม่ได้กำหนดให้ผู้เข้าร่วมค้ารายใดเป็นผู้เข้าร่วมค้าหลัก ผู้เข้าร่วมค้าทุกรายจะต้องมีคุณสมบัติครบถ้วนตามเงื่อนไขที่กำหนดไว้ในเอกสารเชิญชวน กรณีที่ข้อตกลงระหว่างผู้เข้าร่วมค้ากำหนดให้มีการมอบหมายผู้เข้าร่วมค้ารายใดรายหนึ่งเป็น ผู้ยื่นข้อเสนอในนามกิจการร่วมค้า การยื่นข้อเสนอดังกล่าวไม่ต้องมีหนังสือมอบอำนาจ สำหรับข้อตกลงระหว่างผู้เข้าร่วมค้าที่ไม่ได้กำหนดให้ผู้เข้าร่วมค้ารายใดเป็นผู้ยื่นข้อเสนอ ผู้เข้าร่วมค้าทุกรายจะต้องลงลายมือชื่อในหนังสือมอบอำนาจให้ผู้เข้าร่วมค้ารายใดรายหนึ่งเป็นผู้ยื่นข้อเสนอใน นามกิจการร่วมค้า
   3.11 ผู้ยื่นข้อเสนอต้องลงทะเบียนในระบบจัดซื้อจัดจ้างภาครัฐด้วยอิเล็กทรอนิกส์ (Electronic Government Procurement: e - GP) ของกรมบัญชีกลาง
   ๓.๑๒ ผู้ยื่นข้อเสนอต้องมีมูลค่าสุทธิของกิจการ ดังนี้
   3.12.1 กรณีผู้ยื่นข้อเสนอเป็นนิติบุคคลที่จัดตั้งขึ้นตามกฎหมายไทยหรือต่างประเทศ ซึ่งได้จด ทะเบียนเกินกว่า ๑ ปีต้องมีมูลค่าสุทธิของกิจการ จากผลต่างระหว่างสินทรัพย์สุทธิหักด้วยหนี้สินสุทธิที่ ปรากฎในงบแสดงฐานะการเงินที่มีการตรวจรับรองแล้ว ซึ่งจะต้องแสดงค่าเป็นบวก ๑ ปีสุดท้ายก่อน วันยื่น ข้อเสนองบแสดงฐานะการเงิน ๑ ปีสุดท้ายก่อนวันยื่นข้อเสนอ หมายถึง งบแสดงฐานะการเงินย้อนไปก่อนวันที่ หน่วยงานของรัฐกำหนดให้เป็นวันยื่นข้อเสนอ ๑ ปีปฏิทิน เว้นแต่กรณีนิติบุคคลที่จัดตั้งขึ้นตามกฎหมายไทย หากวันยื่นข้อเสนอเป็นช่วงระยะเวลาที่กรมพัฒนาธุรกิจการค้ากำหนดให้นิติบุคคลยื่นงบแสดงฐานะการเงินกับ กรมพัฒนาธุรกิจการค้า ซึ่งจะอยู่ในช่วงเดือนมกราคม - เดือนพฤษภาคม ของทุกปีโดยนิติบุคคลที่เป็นผู้ยื่น ข้อเสนอนั้นยังอยู่ในช่วงของการยื่นงบแสดงฐานะการเงินกับกรมพัฒนาธุรกิจการค้า คือ ช่วงเดือนมกราคม - เดือนพฤษภาคม กรณีนี้ให้สามารถยื่นงบแสดงฐานะการเงินย้อนไปอีก ๑ ปีได้

   ๓.๑๒.๒ กรณีผู้ยื่นข้อเสนอเป็นนิติบุคคลที่จัดตั้งขึ้นตามกฎหมายไทย ซึ่งยังไม่มีการรายงาน งบแสดงฐานการเงินกับกรมพัฒนาธุรกิจการค้า หรือกรณีผู้ยื่นข้อเสนอเป็นนิติบุคคลที่จัดตั้งขึ้นตามกฎหมาย ต่างประเทศซึ่งยังไม่มีการรายงานงบแสดงฐานะการเงิน ให้พิจารณาการกำหนดมูลค่าของทุนจดทะเบียน โดยผู้ยื่นข้อเสนอจะต้องมีทุนจดทะเบียนที่เรียกชำระมูลค่าหุ้นแล้ว ณ วันที่ยื่นข้อเสนอไม่ต่ำกว่า ๑ ล้านบาท
   3.12.3 สำหรับการจัดซื้อจัดจ้างครั้งหนึ่งที่มีวงเงินเกิน ๕๐๐,๐๐๐ บาทขึ้นไป กรณีผู้ยื่นข้อเสนอ เป็นบุคคลธรรมดาให้พิจารณาจากหนังสือรับรองบัญชีเงินฝากไม่เกิน ๙๐ วัน ก่อนวันยื่นข้อเสนอ โดยต้องมีเงิน ฝากคงเหลือในบัญชีธนาคารเป็นมูลค่า ๑ ใน ๔ ของมูลค่างบประมาณของโครงการหรือรายการที่ยื่นข้อเสนอ ในแต่ละครั้ง และหากเป็นผู้ชนะการจัดซื้อจัดจ้างหรือเป็นผู้ได้รับการคัดเลือกจะต้องแสดงหนังสือรับรองบัญชี เงินฝากที่มีมูลค่าดังกล่าวอีกครั้งหนึ่งในวันลงนามในสัญญา
   ๓.๑๒.๔ กรณีที่ผู้ยื่นข้อเสนอไม่มีมูลค่าสุทธิของกิจการหรือทุนจดทะเบียน หรือมีแต่ไม่เพียงพอที่ จะเข้ายื่นข้อเสนอ สามารถดำเนินการได้ดังนี้
   (๑) กรณีผู้ยื่นข้อเสนอเป็นนิติบุคคลที่จัดตั้งขึ้นตามกฎหมายไทย หรือบุคคลธรรมดาที่ถือ สัญชาติไทย ผู้ยื่นข้อเสนอสามารถขอวงเงินสินเชื่อ โดยต้องมีวงเงินสินเชื่อ ๑ ใน ๔ ของมูลค่างบประมาณของ โครงการหรือรายการที่ยื่นข้อเสนอในแต่ละครั้ง จะเป็นสินเชื่อที่ธนาคารภายในประเทศหรือบริษัทเงินทุนหรือ บริษัทเงินทุนหลักทรัพย์ที่ได้รับอนุญาตให้ประกอบกิจการเงินทุนเพื่อการพาณิชย์และประกอบธุรกิจค้ำประกัน ตามประกาศของธนาคารแห่งประเทศไทย ตามรายชื่อบริษัทเงินทุนที่ธนาคารแห่งประเทศไทยแจ้งเวียน
   ให้ทราบโดยพิจารณาจากยอดเงินรวมของวงเงินสินเชื่อที่สำนักงานใหญ่รับรองหรือสำนักงานสาขารับรอง (กรณีได้รับมอบอำนาจจากสำนักงานใหญ่) ซึ่งออกให้แก่ผู้ยื่นข้อเสนอ นับถึงวันยื่นข้อเสนอไม่เกิน ๙๐ วัน (๒) กรณีผู้ยื่นข้อเสนอเป็นนิติบุคคลที่จัดตั้งขึ้นตามกฎหมายต่างประเทศหรือบุคคล ธรรมดาที่มิได้ถือสัญชาติไทย ผู้ยื่นข้อเสนอสามารถขอวงเงินสินเชื่อ โดยต้องมีวงเงินสินเชื่อ ๑ ใน ๔ ของมูลค่า งบประมาณของโครงการหรือรายการที่ยื่นข้อเสนอในแต่ละครั้ง จะเป็นสินเชื่อที่ธนาคารต่างประเทศหรือบริษัท เงินทุนหรือบริษัทเงินทุนหลักทรัพย์ที่ได้รับอนุญาตให้ประกอบกิจการเงินทุนเพื่อการพาณิชย์และประกอบ ธุรกิจค้ำประกัน ตามประกาศของธนาคารกลางต่างประเทศนั้น ตามรายชื่อบริษัทที่ธนาคารกลางต่างประเทศ นั้นแจ้งเวียนให้ทราบ โดยพิจารณาจากยอดเงินรวมของวงเงินสินเชื่อที่สำนักงานใหญ่รับรองหรือสำนักงาน สาขารับรอง (กรณีได้รับมอบอำนาจจากสำนักงานใหญ่) ซึ่งออกให้แก่ผู้ยื่นข้อเสนอ นับถึงวันยื่นข้อเสนอไม่เกิน ๙๐ วัน
   ๓.๑๒.๕ กรณีผู้ยื่นข้อเสนอเป็นนิติบุคคลที่จัดตั้งขึ้นตามกฎหมายต่างประเทศ หรือบุคคลธรรมดาที่ มิได้ถือสัญชาติไทยตามข้อ ๓.๑๒.๒ ข้อ ๓.๑๒.๓ และข้อ ๓.๑๒.๔ (๒) มูลค่าจะต้องเป็นไปตามอัตรา แลกเปลี่ยนเงินตราตามประกาศที่ธนาคารแห่งประเทศไทยกำหนด ในช่วงระหว่างวันที่เผยแพร่ประกาศ
   และเอกสารประกวดราคาในระบบจัดซื้อจัดจ้างภาครัฐด้วยอิเล็กทรอนิกส์ (e-GP) จนถึงวันเสนอราคา ทั้งนี้ ผู้ยื่นข้อเสนอจะต้องยื่นเอกสารที่แสดงให้เห็นถึงข้อมูลเกี่ยวกับมูลค่าสุทธิของกิจการ แล้วแต่กรณี ประกอบกับเอกสารดังกล่าวจะต้องผ่านการรับรองตามระเบียบกระทรวงต่างประเทศว่าด้วยการ รับรองเอกสาร พ.ศ. ๒๕๓๙ และที่แก้ไขเพิ่มเติม กำหนด โดยจะต้องยื่นเอกสารดังกล่าวในวันยื่นข้อเสนอ หาก ผู้ยื่นข้อเสนอมิได้มีการยื่นเอกสารดังกล่าวมาพร้อมกับการยื่นข้อเสนอให้ถือว่า ผู้ยื่นข้อเสนอรายนั้นยื่นเอกสาร ไม่ครบถ้วนตามเงื่อนไขที่กำหนดไว้ในเอกสารประกวดราคา
   ๓.๑๒.๖ กรณีตามข้อ…

   ๓.๑๒.๖ กรณีตามข้อ ๓.๑๒.๑ – ๓.๑๒.๕ ไม่ใช้บังคับกับกรณีดังต่อไปนี้
   (๑) กรณีที่ผู้ยื่นข้อเสนอเป็นหน่วยงานของรัฐภายในประเทศ
   (๒) นิติบุคคลที่จัดตั้งขึ้นตามกฎหมายไทยที่อยู่ระหว่างการฟื้นฟูกิจการตามพระราชบัญญัติ ล้มละลาย พ.ศ. ๒๔๘๓ และที่แก้ไขเพิ่มเติม
   (๓) งานจ้างก่อสร้างที่กรมบัญชีกลางได้ขึ้นทะเบียนผู้ประกอบการงานก่อสร้างแล้ว และงานจ้างก่อสร้างที่หน่วยงานของรัฐที่ได้มีการจัดทำบัญชีผู้ประกอบการงานก่อสร้างที่มีคุณสมบัติเบื้องต้นไว้ แล้วก่อนวันที่พระราชบัญญัติการจัดซื้อจัดจ้างฯ มีผลใช้บังคับ
   (๔) การจัดซื้อจัดจ้างตามมาตรา ๕๖ วรรคหนึ่ง (๒) (ข) และ (ค) แห่งพระราชบัญญัติ การจัดซื้อจัดจ้างฯ
   (๕) การซื้ออสังหาริมทรัพย์และการเช่าอสังหาริมทรัพย์
   (๖) กรณีงานจ้างบริการหรืองานจ้างเหมาบริการกับบุคคลธรรมดา เช่น จ้างพนักงานขับรถ ครูชาวต่างชาติ พนักงานเก็บขยะ พนักงานบันทึกข้อมูล เป็นต้น
   ๓.๑๓ ผู้ยื่นข้อเสนอต้องมีผลงานประเภทเดียวกันกับงานที่ประกวดราคา และเป็นผลงานระบบ สารสนเทศทางห้องปฏิบัติการ เพื่อการเฝ้าระวังป้องกันควบคุมโรคที่เป็นคู่สัญญาโดยตรงกับส่วนราชการ หรือหน่วยงานอื่นๆ จำนวนอย่างน้อย ๑ ผลงาน (ผลงานที่ได้ส่งมอบงานตามสัญญาเรียบร้อยแล้วไม่เกิน 5 ปี นับจากวันที่แล้วเสร็จจนถึงวันที่ประกาศประกวดราคาจ้างด้วยวิธีอิเล็กทรอนิกส์ในครั้งนี้) ที่มีใช้งานอยู่ใน ปัจจุบัน ที่มีวงเงินไม่น้อยกว่า 2๐๐,๐๐๐.- บาท (สองแสนบาทถ้วน) ต่อหนึ่งผลงาน โดยให้แนบเอกสารผลงาน หรือสำเนาสัญญาจ้างมาพร้อมกับการยื่นเอกสารเสนอราคา
   ๓.๑4 หากคุณสมบัติของผู้ยื่นข้อเสนอข้อใด ข้อหนึ่งไม่ชัดเจน สถาบันฯ สงวนสิทธิ์ในการขอข้อมูล เพิ่มเติมเพื่อประกอบการพิจารณา
   3.15 คุณสมบัติเฉพาะผู้ยื่นข้อเสนอต้องมีผลงานเชิงประจักษ์ในการออกแบบระบบสารสนเทศ ในการบริหารจัดการข้อมูลทางห้องปฏิบัติการ
   3.16 ผู้ยื่นข้อเสนอต้องจัดให้มีทีมงานที่รับผิดชอบของโครงการนี้ โดยอย่างน้อยดังนี้ (1) ผู้จัดการโครงการ (Project Manager) โดยมีวุฒิการศึกษาไม่ต่ำกว่าปริญญาตรี จำนวนไม่น้อยกว่า 1 คน
   (2) นักพัฒนาโปรแกรม (Programmer) โดยมีวุฒิการศึกษาไม่ต่ำกว่าปริญญาตรี ด้านคอมพิวเตอร์ และมีจำนวนไม่น้อยกว่า 2 คน
   (3) ที่ปรึกษาด้านเทคนิคการแพทย์ โดยมีวุฒิการศึกษาไม่ต่ำกว่าปริญญาตรี และมีประสบการณ์ ด้านระบบสารสนเทศทางห้องปฏิบัติการ 5-10 ปี จำนวน 1 คน
   (4) ผู้เสนอราคาต้องมีเจ้าหน้าที่ประสานงานโครงการเพื่อประสานงาน และสนับสนุนการดำเนินงาน ให้เป็นไปตามแผนอย่างน้อย 1 คน
   3.17 ผู้ยื่นข้อเสนอต้องแนบประวัติการศึกษา ประสบการณ์ของทีมงานในการพัฒนาระบบงาน คอมพิวเตอร์ด้วย ตามข้อ 3.16 (2) และ(3) พร้อมทั้งแนบเอกสารดังกล่าวมาในวันยื่นเสนอราคา หากทางสถาบันฯ ตรวจสอบคุณสมบัติของผู้ยื่นข้อเสนอข้อใดข้อหนึ่งไม่ครบถ้วนและชัดเจน สถาบันฯ สงวนสิทธิ์ในการขอข้อมูลเพิ่มเติมเพื่อประกอบการพิจารณา

4. ขอบเขตของงานที่จะดำเนินการจัดจ้าง
   4.1 ผู้รับจ้างจะต้องออกแบบโครงสร้างสถาปัตยกรรมของศูนย์ข้อมูล (Data Center Architecture) สำหรับ DDC Lab Data Center ที่รองรับข้อมูลทางห้องปฏิบัติการโดยเฉพาะ (LaboratoryData- Centric Architecture) โดยต้องพิจารณารูปแบบการติดตั้งทั้งแบบ On-premise หรือ Cloud โดยพิจารณาให้เหมาะสมกับบริบทของหน่วยงาน
   4.2 ผู้รับจ้างต้องออกแบบระบบฐานข้อมูลกลาง (Centralized Database) ที่สามารถรองรับการรวบรวม จัดเก็บ และบริหารจัดการข้อมูลจำนวนมากจากหลายแหล่ง และสามารถขยายระบบได้ในอนาคต (Scalability) รวมถึงต้องกำหนดแนวทางการบริหารจัดการข้อมูล (Data Governance) ครอบคลุม ดังนี้
   4.2.1 การควบคุมคุณภาพข้อมูล (Data Quality)
   4.2.2 ความปลอดภัยของข้อมูล (Data Security)
   4.2.3 การกำหนดสิทธิ์การเข้าถึงข้อมูล (Access Control)
   4.3 ผู้รับจ้างต้องออกแบบกลไกการเชื่อมโยงข้อมูล (Integration Layer) ที่สอดคล้องกับระบบ สุขภาพเช่น HL7 หรือ FHIR เป็นต้น เพื่อให้สามารถแลกเปลี่ยนข้อมูลระหว่างระบบได้ อย่างมีประสิทธิภาพและปลอดภัย โดยต้องกำหนด
   4.3.1 FHIR Resource ที่ใช้ เช่น Patient, Order, Result เป็นต้น
   4.3.2API Specification (RESTful API)
   4.3.3Data Exchange Pattern (Push / Pull / Event-driven)
   4.4 ผู้รับจ้างจะต้องออกแบบและพัฒนากลไกการเชื่อมโยงข้อมูล(Data Integration) ระหว่างหน่วยงานต่างๆ ทั้งภายในและภายนอกองค์กร ได้แก่สถาบันบำราศนราดูร และห้องปฏิบัติการระดับเขต (สคร.) อย่างน้อย 1 แห่ง โดยระบบต้องสามารถรองรับการแลกเปลี่ยนข้อมูลผ่าน API -based Integration หรือตามมาตรฐานสากล เช่น HL7 หรือ FHIR และสามารถจัดการการ Mapping ข้อมูลระหว่าง ระบบที่มีโครงสร้างแตกต่างกันได้
   4.5 ผู้รับจ้างจะต้องกำหนดชุดข้อมูลมาตรฐานกลาง (Standard Data Set) สำหรับข้อมูลทาง ห้องปฏิบัติการระดับเขต (สคร.) หรือส่วนกลาง เพื่อใช้เป็นมาตรฐานเดียวกันในการจัดเก็บ และแลกเปลี่ยนข้อมูลระหว่างหน่วยงาน โดยต้องพิจารณาและอ้างอิงมาตรฐานสากล เช่น LOINC เป็นต้น
   4.6 ผู้รับจ้างจะต้องออกแบบโครงสร้างข้อมูลและแนวทางสำหรับการวิเคราะห์ข้อมูลเชิงระบาดวิทยา (Epidemiological Analytics) เพื่อสนับสนุนการติดตามสถานการณ์โรคและการตัดสินใจ เชิงนโยบาย โดยต้องกำหนดรูปแบบ Dashboard สามารถแสดงข้อมูลในรูปแบบที่เข้าใจง่าย เช่น กราฟ แผนที่ หรือ Trend Analysis และสามารถรายงานผลการเฝ้าระวังเชื้อก่อโรค ทางห้องปฏิบัติการ (Lab surveillance) เช่น เชื้อก่อโรคระบบสมองและประสาท (Encephalitis) และเชื้อไวรัสก่อโรคอุจจาระร่วงเฉียบพลัน (Viral diarrhea) เป็นอย่างน้อยดังนี้

   ๔.๖.๑.๑ โรคเอดส์และโรคติดต่อทางเพศสัมพันธ์ ได้แก่ Anti-HIV, Syphilis Test
   ๔.๖.๑.๒ โรคติดเชื้อนำโดยแมลง ได้แก่ Dengue, Chikungunya, Zika virus, Malaria, Scrub typhus, Leishmaniasis, Filariasis
   ๔.๖.๑.๓ โรคติดเชื้อระบบทางเดินหายใจ ได้แก่ Adenovirus, Coronavirus 229E, Coronavirus HKU1, Coronavirus NL63, Coronavirus OC43, Human Metapneumovirus, Rhinovirus/Enterovirus, Influenza A, Influenza A subtype H1N1/2009, Influenza A subtype H1, Influenza A subtype H3, Influenza B, Parainfluenza virus 1/2/3/4, Respiratory Syncytial Virus,SARS-CoV-2, Bordetella pertussis, Chlamydophila pneumoniae, Mycoplasma pneumoniae
   ๔.๖.๑.๔ วัณโรค ได้แก่ Realtime PCR, IGRAs, Culture, Drug susceptibility testing ๔.๖.๑.๕ ภูมิคุ้มกันวิทยา (Immunology) ได้แก่ HBsAg, Anti-HCV, HBc Ab, HBs Ab ๔.๖.๑.๖ ไวรัสตับอักเสบ ได้แก่ การตรวจหาปริมาณไวรัสตับอักเสบบีและซี ๔.๖.๑.๗ โรคติดต่ออันตราย ๑๓ โรค ได้แก่กาฬโรค (Plague), ไข้ทรพิษหรือฝีดาษ (Smallpox), ไข้เลือดออกไครเมีย –คองโก (Crimean – Congo hemorrhagic fever), ไข้เวสต์ไนล์(West Nile Fever), ไข้เหลือง (Yellow Fever), โรคไข้ลาสซา (Lassa fever), โรคติดเชื้อไวรัสนิปาห์ (Nipah virus disease), โรคติดเชื้อไวรัส มาร์บวร์ก (Marburg virus disease), โรคติดเชื้อไวรัสอีโบลา (Ebola virus disease – EVD), โรคติดเชื้อไวรัสเฮนดรา (Hendra virus disease), โรคซาร์ส (Severe Acute Respiratory Syndrome – SARS), โรคเมอร์ส (Middle East Respiratory Syndrome – MERS), วัณโรคดื้อยาหลายขนานชนิดรุนแรงมาก (Extensively drug – resistant tuberculosis ; XDR-TB)
   4.7 ผู้รับจ้างจะต้องพัฒนาข้อมูลสารสนเทศทางห้องปฏิบัติการ DDC Lab Data Center ตามที่ได้ ออกแบบไว้ เพื่อใช้ในการทดสอบและประเมินผลการใช้งานจริง ต้องดำเนินการติดตั้งระบบ บนโครงสร้างพื้นฐาน เช่น Cloud Server และดำเนินการทดสอบระบบร่วมกับผู้ใช้งาน (User Acceptance Test: UAT) รวมถึงต้องปรับปรุงแก้ไขระบบตามข้อเสนอแนะจากการทดสอบ เพื่อให้ระบบมีความพร้อมสำหรับการนำไปใช้งานจริง
   4.8เงื่อนไข…

   4.8 เงื่อนไขเฉพาะ
   4.8.1 ผู้ยื่นข้อเสนอต้องมีหนังสือผ่านการรับรองตามมาตรฐานสากล ได้แก่ ระบบบริหารคุณภาพ ขององค์กร (ISO 9001 : 2015)และมาตรฐานด้านการจัดการคุณภาพของเครื่องมือแพทย์ ตั้งแต่การออกแบบ พัฒนา (ISO 13485 : 2016 ) และระบบมาตรฐานความปลอดภัย สารสนเทศ (ISO 27001 : 2022 ) และระบบมาตรฐานด้านการจัดการความปลอดภัย
   ของข้อมูลภายในองค์กรด้านสุขภาพ (ISO 27799 : 2016) เนื่องจากเป็นข้อมูลของผู้ป่วย ที่มีการเชื่อมโยงข้อมูลทางห้องปฏิบัติการเพื่อการเฝ้าระวังป้องการควบคุมโรค ระดับประเทศ จึงต้องมีมาตรฐานด้านสารสนเทศระดับสากลควบคุมป้องกันรักษาความปลอดภัยของข้อมูล อย่างมีประสิทธิภาพ ยื่นในวันเสอนราคา
   4.8.2 ผู้ยื่นข้อเสนอต้องจัดทำเอกสารเปรียบเทียบขอบเขตของงาน (Terms of Reference : TOR) ของผู้ยื่นข้อเสนอกับขอบเขตของงาน (Terms of Reference : TOR) ที่สถาบันฯ กำหนด และให้แนบเอกสารดังกล่าวมาพร้อมกับเอกสารในวันยื่นเสนอราคา
   4.8.3 ผู้ยื่นข้อเสนอต้องนำเสนอตัวอย่างการออกแบบ Prototype ให้กับผู้ใช้งาน ณ กลุ่มงานปฏิบัติการ เทคนิคการแพทย์และอ้างอิงด้านโรคติดเชื้อ สถาบันบำราศนราดูร ภายใน 3 วันทำการ ในวันเวลาที่สถาบันบำราศนราดูรกำหนด
   4.8.4 ผู้ยื่นข้อเสนอต้องผ่านเกณฑ์การประเมิน และได้หนังสือรับรองจากสถาบันบำราศนราดูร โดยมีผลการประเมินไม่น้อยกว่าร้อยละ 80 และยื่นผลการประเมินในวันยื่นเสนอราคา 4.8.5 ผู้ยื่นข้อเสนอต้องจัดทำต้นฉบับเอกสารคุณลักษณะตามข้อเสนอ โดยเสนอขอบเขตของงาน ข้อ 4.๑ – 4.๗ และหนังสือรับประกันความชำรุดบกพร่อง ตามข้อ 10 จำนวน 1 ชุด ในวันยื่นเสนอราคา
   4.8.6 ผู้รับจ้างมีหน้าที่บำรุงรักษาและซ่อมแซมแก้ไขปัญหาของการจัดทำข้อมูลให้ได้ตามผู้ว่าจ้าง กำหนดตลอดระยะเวลาที่รับประกัน โดยผู้รับจ้างเป็นผู้ออกค่าใช้จ่ายทั้งหมด ยกเว้นปัญหา ที่มาจาก cloud และคอมพิวเตอร์ของผู้ใช้งาน รวมทั้งอุปกรณ์อิเล็คทรอนิคของผู้ใช้งาน 4.8.7 ผู้รับจ้างจะต้องจัดอบรมให้แก่เจ้าหน้าที่ของหน่วยงาน เพื่อให้สามารถใช้งานระบบได้อย่าง ถูกต้อง และต้องจัดทำเอกสารประกอบ เช่น คู่มือผู้ใช้งาน (User Manual) และเอกสารด้านเทคนิค (Technical Documentation)
   4.8.8 ผู้รับจ้างจะไม่เปิดเผยข้อมูลทุกชนิดโดยไม่กระทำเองหรือร่วมกับบุคคลใดในการนำข้อมูลไปใช้ ไม่ว่าเพื่อวัตถุประสงค์ใดๆ หรือเผยแพร่ข้อมูลไม่ว่าโดยวิธีการใดๆ โดยมิได้รับความยินยอม เป็นหนังสือจากผู้ว่าจ้างและปฏิบัติตามพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 4.8.9 ในกรณีที่ไม่สามารถคัดเลือกผู้รับจ้างที่มีคุณสมบัติและราคาที่เหมาะสมได้สถาบันบําราศนราดูร ขอสงวนสิทธิ์ในการยกเลิกการประกวดราคา ทั้งนี้ผู้ยื่นข้อเสนอจะเรียกร้องค่าใช้จ่ายใดๆไม่ได้ทั้งสิ้น 5. กำหนดเวลาส่งมอบพัสดุ
   ผู้รับจ้างจะต้องส่งมอบงานจ้าง ตามสัญญานี้ให้ถูกต้องและครบถ้วนตามที่กำหนดให้แก่ผู้ว่าจ้าง ณ สถาบันบำราศนราดูร เลขที่ 38 ถนนติวานนท์ ตำบลตลาดขวัญ อำเภอเมือง จังหวัดนนทบุรี 11000 ภายใน 12๐ วัน นับถัดจากวันลงนามในสัญญา
5. หลักเกณฑ์ในการพิจารณาคัดเลือกข้อเสนอ
   การพิจารณาผลการยื่นข้อเสนอประกวดราคาอิเล็กทรอนิกส์ครั้งนี้ สถาบันบำราศนราดูร จะพิจารณาตัดสินโดยใช้เกณฑ์ราคา และจะพิจารณาจากราคารวม

7. วงเงินงบประมาณ/วงเงินที่ได้รับจัดสรร
   ในวงเงินทั้งสิ้น 3,000,000.00 บาท (สามล้านบาทถ้วน) จ่ายจากเงินงบประมาณโครงการพัฒนา ศักยภาพระบบเฝ้าระวังโรคอุบัติใหม่ อุบัติซ้ำ และโรคติดต่ออันตรายด้วยเทคโนโลยี API for LAB-EID ผลผลิตที่ 7 กิจกรรมหลักที่ 7.2 กิจกรรมที่ 2 พัฒนาระบบการเชื่อมโยงฐานข้อมูลทางห้องปฏิบัติการภายใน กรมควบคุมโรค (API program) กิจกรรมย่อยที่ 2.1 จ้างเหมาออกแบบระบบข้อมูลทางห้องปฏิบัติการ (DDC Lab data center) เพื่อเฝ้าระวังป้องกันควบคุมโรค
8. งวดงานและการจ่ายเงิน
   8.1 จำนวน 1 งวด สถาบันบำราศนราดูร จะจ่ายค่าจ้างให้แก่ผู้ยื่นข้อเสนอที่ได้รับการคัดเลือกให้เป็น ผู้รับจ้างเมื่อผู้รับจ้างได้ส่งมอบงาน ได้ครบถ้วนตามสัญญาจ้างหรือข้อตกลงเป็นหนังสือ และสถาบันได้ตรวจรับ ส่งมอบงานเรียบร้อยแล้ว
   8.2 การส่งรายงานต้องเป็นรูปแบบเป็นอิเล็กทรอนิกส์ไฟล์(word document)และรูปเล่มจำนวน 2 ชุด 9. อัตราค่าปรับ
   ผู้รับจ้างจะต้องชำระค่าปรับให้แก่ผู้ว่าจ้างเป็นรายวัน ในอัตราร้อยละ 0.10 ของราคางานจ้างนับถัดจาก วันที่ครบกำหนดเวลาแล้วเสร็จของงานตามสัญญาหรือวันที่ผู้ว่าจ้างได้ขยายเวลาทำงานให้จนถึงวันที่ ทำงานแล้วเสร็จจริง
9. การกำหนดระยะเวลารับประกันความชำรุดบกพร่อง
   เมื่องานแล้วเสร็จบริบูรณ์ และผู้ว่าจ้างได้รับมอบงานจากผู้รับจ้างหรือจากผู้รับจ้างรายใหม่ ในกรณีที่มีการบอกเลิกสัญญาตามข้อ 6 หากมีเหตุชำรุดบกพร่องหรือเสียหายเกิดขึ้นจากการจ้างนี้ ภายในกำหนด 1 (หนึ่ง) ปีนับถัดจากวันที่ได้รับมอบงานดังกล่าวซึ่งความชำรุดบกพร่องหรือเสียหายนั้นเกิด จากความบกพร่องของผู้รับจ้างอันเกิดจากการใช้วัสดุที่ไม่ถูกต้องหรือทำไว้ไม่เรียบร้อย หรือทำไม่ถูกต้องตาม มาตรฐานแห่งหลักวิชา ผู้รับจ้างจะต้องรีบทำการแก้ไขให้เป็นที่เรียบร้อยโดยไม่ชักช้า โดยผู้ว่าจ้างไม่ต้องออก เงินใด ๆ ในการนี้ทั้งสิ้น หากผู้รับจ้างไม่กระทำการดังกล่าวภายในกำหนด 5 (ห้า) วัน นับถัดจากวันที่ได้รับ แจ้งเป็นหนังสือจากผู้ว่าจ้างหรือไม่ทำการแก้ไขให้ถูกต้องเรียบร้อยภายในเวลาที่ผู้ว่าจ้างกำหนด ให้ผู้ว่าจ้างมีสิทธิที่จะทำการนั้นเองหรือจ้างผู้อื่นให้ทำงานนั้น โดยผู้รับจ้างต้องเป็นผู้ออกค่าใช้จ่ายเองทั้งสิ้น
   ในกรณีเร่งด่วนจำเป็นต้องรีบแก้ไขเหตุชำรุดบกพร่องหรือเสียหายโดยเร็ว และไม่อาจรอให้ผู้รับจ้าง แก้ไขในระยะเวลาที่กำหนดไว้ตามวรรคหนึ่งได้ ผู้ว่าจ้างมีสิทธิเข้าจัดการแก้ไขเหตุชำรุดบกพร่อง หรือเสียหายนั้นเอง หรือจ้างผู้อื่นให้ซ่อมแซมความชำรุดบกพร่องหรือเสียหาย โดยผู้รับจ้างต้องรับผิดชอบ ชำระค่าใช้จ่ายทั้งหมด
   การที่ผู้ว่าจ้างทำการนั้นเอง หรือจ้างผู้อื่นให้ทำงานนั้นแทนผู้รับจ้าง ไม่ทำให้ผู้รับจ้างหลุดพ้น จากความรับผิดตามสัญญา หากผู้รับจ้างไม่ชดใช้ค่าใช้จ่ายหรือค่าเสียหายตามที่ผู้ว่าจ้างเรียกร้องผู้ว่าจ้าง มีสิทธิบังคับจากหลักประกันการปฏิบัติตามสัญญาได้
